On November 17, 2025, the U.S. Environmental Protection Agency and the Department of the Army announced the signing of a proposed rule to revise the definition of “waters of the United States.”
This proposed ruling implements the Supreme Court's decision in Sackett v. EPA. The Supreme Court significantly narrowed the federal government's authority to regulate wetlands under the Clean Water Act (CWA). This decision overturned previous, broader interpretations, and critics argue it could leave millions of acres of wetlands and many streams vulnerable to pollution and development without federal oversight.
